KELVADO, S.L.U. operates the service under the trade name Kelbado.

2. Purpose

This Legal Notice governs access to and use of the website https://kelbado.eu and the application https://app.kelbado.eu (the "Site"), through which KELVADO, S.L.U. provides an AI-assisted platform for creating, distributing and tracking online training (the "Service").

Use of the Service is further governed by the Terms of Service, the Privacy Policy and the Cookie Policy.

3. Conditions of access and use

Access to the Site is free of charge, except for the cost of the connection itself. Access to certain functionality requires registration and, where applicable, a paid plan.

Users undertake to use the Site diligently and not to use it to:

• carry out unlawful activities or activities contrary to good faith and public order;
• distribute racist, xenophobic or pornographic content, content glorifying terrorism, or content infringing human rights;
• damage the physical or logical systems of KELVADO, S.L.U., its suppliers or third parties;
• introduce or distribute computer viruses or any other systems liable to cause damage.

Specific conditions applicable to AI-generated content are set out in the Terms of Service and in the AI Transparency Notice.

4. Intellectual and industrial property

All rights in the software, design, navigation structure, databases, trade marks and distinctive signs of the Site belong to KELVADO, S.L.U. or its licensors.

Materials uploaded to the Service by a user or their organisation, and the courses generated from them, remain the property of that user or organisation on the terms set out in the Terms of Service. KELVADO, S.L.U. acquires no ownership rights in that content beyond what is strictly necessary to provide the Service.

Reproduction, distribution, public communication or transformation of elements owned by KELVADO, S.L.U. without express written authorisation is prohibited.

5. Liability

KELVADO, S.L.U. provides a tool: responsibility for training content created, published or distributed through the platform lies with the person or entity that creates and publishes it.

KELVADO, S.L.U. does not warrant uninterrupted availability or the absence of errors, although it takes reasonable measures to prevent them. It is not liable for damage arising from improper use of the Service or for content hosted by users, without prejudice to its obligations as a hosting service provider under Regulation (EU) 2022/2065 (DSA).

AI-generated content may contain errors or inaccuracies and must be reviewed by a human before publication or training use.

6. Links

The Site may contain links to third-party sites. KELVADO, S.L.U. does not control those sites and is not responsible for their content. A link does not imply any relationship, recommendation or supervision.

7. Point of contact (Digital Services Act)

Under articles 11 and 12 of Regulation (EU) 2022/2065, the single point of contact for authorities and for recipients of the service is: support@kelbado.eu. Communications may be sent in Spanish or English.

The notice-and-action procedure for illegal content is described in the Terms of Service.

8. Data protection

Processing of personal data is governed by the Privacy Policy. For any data-protection matter: support@kelbado.eu.

9. Dispute resolution and applicable law

These conditions are governed by Spanish law. For any question concerning the interpretation, application and performance of this Legal Notice, the parties submit to the courts of the user's domicile where the user is a consumer, and otherwise to the courts of the city of Barcelona.

Consumers may request official complaint forms (hojas de reclamación) at support@kelbado.eu and may turn to the Spanish Consumer Arbitration System (Sistema Arbitral de Consumo — the Consumer Arbitration Board of Catalonia or that of the consumer's own autonomous community), as well as to the consumer-protection authorities of their place of residence.

10. Changes

KELVADO, S.L.U. may amend this Legal Notice. The version in force, with its version number and effective date, is always published on this page; previous versions are archived and can be requested at support@kelbado.eu.
