1. Who these terms apply to
These terms apply when you buy as a consumer, that is, outside any trade, business or profession. They supplement the general Terms of Service and prevail over them, in anything more favourable to you, in the event of conflict.
If you buy on behalf of a company or a professional, only the Terms of Service apply.
Kelbado is a service addressed to companies, professionals and organisations that train their staff; prices on the pricing page are therefore shown excluding VAT. This does not limit your rights: if you buy as a consumer, these terms protect you in full.
2. Pre-contractual information
- Provider: KELVADO, SOCIEDAD LIMITADA (Sociedad Unipersonal), tax ID B93797355, Calle Lepanto, 270, bajos, 08013 Barcelona, España. Registry details and contact in the Legal Notice.
- Main characteristics: access to the Kelbado platform to create, publish and track online training with artificial-intelligence assistance, within the seat, storage and credit limits of the chosen plan.
- Access and technical requirements: the service is delivered online and requires an internet connection. It supports the current and the previous major version of Chrome, Firefox, Safari and Edge, on desktop and mobile.
- Functionality and interoperability: courses can be exported in SCORM 1.2, SCORM 2004, cmi5, xAPI, PDF and Markdown for use on other platforms. Exported content carries no technical protection measures or DRM.
- Price: as shown on the pricing page at the time of purchase, where it is displayed excluding VAT because the service is addressed to businesses. If you buy as a consumer, the final price including the taxes of your country of residence is shown at checkout before you confirm the purchase. There are no delivery charges.
- Duration and renewal: the subscription runs monthly or annually depending on the plan and renews automatically for equal periods until you cancel it from Settings → Billing.
- Minimum duration of your obligations: the billing period you choose (monthly or annual); there is no further minimum commitment.
- Your data when the subscription ends: you have thirty (30) calendar days to export it; after that it is deleted or anonymised, as set out in clause 9 of the Terms.
- Payment methods: those offered by the Merchant of Record at checkout (card and other local methods).
- Contract languages: Spanish or English, at your choice.
- Confirmation: after purchase you receive an email with the order summary and links to these terms, to the Refund Policy and to support.
3. How the contract is concluded
- You choose a plan on the pricing page.
- You create an account or sign in.
- Before paying you accept the Terms, the Privacy Policy and the Refund Policy, and confirm whether you want immediate access.
- You complete payment on the Merchant of Record's checkout.
- You receive the confirmation email and access becomes active.
You can correct the data you entered at any step before payment.
4. Who invoices you
Depending on your country of residence, the purchase is concluded and invoiced by a Merchant of Record: Creem in the European Union and Paddle.com Market Limited elsewhere. That provider appears at checkout and on the receipt and applies its own buyer terms in addition. The service itself is provided by KELVADO, S.L.U..
The Max and Enterprise plans are contracted by purchase order and invoiced directly by KELVADO, SOCIEDAD LIMITADA (Sociedad Unipersonal), payable by bank transfer, as set out in clause 5.1 of the Terms.
5. Right of withdrawal
You have fourteen (14) calendar days from the conclusion of the contract to withdraw without giving a reason and without penalty.
Loss of the right: because this is digital content and a service performed immediately, if you expressly ask to start using the platform before that period ends and acknowledge that by doing so you lose the right of withdrawal, that right lapses once performance has begun (article 103.m RDL 1/2007). That request and acknowledgement are collected through a specific checkbox at checkout, separate from acceptance of the terms.
To withdraw, an unequivocal statement to support@kelbado.eu is enough. You may use this model form:
To KELVADO, SOCIEDAD LIMITADA (Sociedad Unipersonal), Calle Lepanto, 270, bajos, 08013 Barcelona, España, support@kelbado.eu: I hereby give notice that I withdraw from my contract for the supply of the following service: [plan purchased]. Ordered on: [date]. Name of consumer: [name]. Address of consumer: [address]. Order number: [number]. Date: [date].
We will refund the payments received without undue delay and in any event within fourteen (14) calendar days of your notice, using the same payment method.
6. Legal guarantee of conformity for digital content
We are liable for any lack of conformity of the service and digital content under articles 115 et seq. of RDL 1/2007: the service must match its description, be fit for its intended purpose and be kept updated for the duration of the contract.
If you find a lack of conformity, write to support@kelbado.eu; you are entitled to have the service brought into conformity and, where that is impossible or not done within a reasonable time, to a price reduction or to terminate the contract with a proportionate refund.
Responsibility for training content that you yourself create or publish with the tool lies with its creator, under clause 3 of the Terms.
7. Use of artificial intelligence
The service generates content using artificial-intelligence models. That content may contain errors and must be reviewed before use. This characteristic forms part of the description of the service and is detailed in the AI Transparency Notice.
8. Customer service and complaints
- Support and complaints: support@kelbado.eu.
- Official complaint forms (hojas de reclamación) available on request at the same address.
- Consumer Arbitration System (Sistema Arbitral de Consumo): you may apply to the Consumer Arbitration Board of Catalonia or to the board of your own autonomous community.
- You may also contact the consumer-protection authorities of your place of residence (region or country).
9. Applicable law
Spanish law applies and, where more protective, the law of your country of habitual residence in the European Union. You retain the right to bring proceedings before the courts of your domicile.
